Client Terms and Conditions

Welcome to Mathema Stars!

These terms and conditions outline the rules and regulations for the use of Mathema Stars's Website, located at https://www.mathemastars.co.uk.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Mathema Stars if you do not agree to take all of the terms and conditions stated on this page.

This agreement applies between you, the Client, and Mathema Stars Tutors. Your agreement to comply with and be bound by these terms and conditions is deemed to occur when you first access the website or liaise directly with Mathema Stars Tutors. No variation or alteration of these terms and conditions shall be valid unless approved in writing by a Director of Mathema Stars. Mathema Stars reserves the right to alter and update these terms and conditions.

Tutorials

By agreement of these Terms of Business a contractual relationship is formed by Mathema Stars Tutors and the Client whereby Mathema Stars acts as an agent of the Tutor providing introductions of Tutors to clients and vice versa. Mathema Stars collects the fees in advance on behalf of the Tutor.
Scheduled tutorials will always take place on the day and time and venue agreed upon by the Client and the Tutor. Lessons will continue until a mutually agreed termination date. A written notification must be made to Mathema Stars.
Mathema Stars Tutors strive to provide the best possible service. However, we cannot be held liable, accountable or responsible for the academic success or lack thereof demonstrated by the Client. Although we are willing to do everything within our power to help grades and skill sets improve, we cannot offer any guarantee of this.
Any opinion given or spoken by the Tutor is not necessarily the expression of opinion of Mathema Stars.

Payment for Tuition

Fees are agreed prior to tuition commencing between Mathema Stars and the Client.
They are not to be agreed with the Tutor or paid to the Tutor direct. Fees are normally a standard rate appropriate to the level of the tuition being provided.
Bookings are made in advance for the month. Bookings must be paid in advance, in full, direct to Mathema Stars prior to the commencement of the first session. The prepaid sessions are valid for no longer of 6 weeks from that start of the first session, or 6 weeks since payment was received.
Invoices are due to be paid no later than 7 days from the date of the invoice or before the first session of the month. In the event of late or no payment, Mathema Stars reserves the right to cancel sessions.

Cancellation

Cancellation or rescheduling of classes must be made with 48hrs notice to the tutors and notified to Mathema Stars. No refunds will be provided for any cancellation after this period.
Mathema Stars, however, are aware that classes are required to be rearranged or cancelled due to unforeseen circumstances. In which case Mathema Stars will act accordingly.
The Client is entitled to cancel the contract between themselves and Mathema Stars at any time, within 5 working days prior to the next session. In which case the client will be entitled to a refund of all outstanding sessions.
In the event a Tutor fails to turn up to a tuition session, without prior notice, Mathema Stars should be notified as soon as possible. Mathema Stars will endeavour to reschedule the lesson as soon as possible, to a day that is suitable for the Client or refund the Client for the missed lesson.

Tuition stopped by a Tutor or Mathema Stars

If a Tutor, for any reason, has to stop tuition mid-course, Mathema Stars seek to minimise disruption to the pupil’s progress and will endeavour to source a replacement Tutor as soon as possible, subject to availability.

Non-solicitation

The Client is not permitted to make private arrangements for tuition with a Tutor introduced to them by Mathema Stars. Should a Client breach this obligation, they will liable to account to Mathema Stars for all sums paid to the Tutor without deduction and Mathema Stars shall be entitled to obtain an injunction against a Client to prevent further breaches. This obligation shall continue not withstanding termination of this agreement.

This Agreement shall begin on the date hereof.

Parts of this website offer users an opportunity to post and exchange opinions and information in certain areas of the website. Mathema Stars does not filter, edit, publish or review Comments before their presence on the website. Comments do not reflect the views and opinions of Mathema Stars, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. Mathema Stars, and any Tutor working through Mathema Stars, is not liable for any direct, incidental, consequential, indirect, special, punitive or similar damages arising out of use of our tutoring service, or any errors or omissions in the content of our materials. You as the client specifically waivers any and all claims arising out of the use of this tutoring service.

Mathema Stars cannot be held responsible for chaperoning pupils, and nor is responsible for safeguarding the house and effects within whilst tutoring sessions are taking place.

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are raised on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights:

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

Clients providing personal data to Mathema Stars are consenting them to the use of the information enabling them to be able to provide the service Mathema Stars offer. This may include Mathema Stars using information onto third parties, for example Tutors, using it for billing and fee collecting and allow a continuous dialog between the Client and Mathema Stars Tutors.

All materials that Mathema Stars create in-house are copyright. You, the Client, agree that you will not distribute or publish any portion of any materials without prior written consent from Mathema Stars and Tutors.
